Refund & Cancellation Policy

1. Overview

At Kudoby Technologies Pvt. Ltd, we are committed to delivering high-quality software development services. We understand that circumstances may change, and we have established this policy to address refunds and cancellation requests fairly. Please read this policy carefully before engaging our services.

2. Project Cancellation by Client

If you wish to cancel your project, the following terms apply:

  • Before Project Start: Full refund of any deposits paid, minus a 10% administrative fee.
  • During Discovery/Planning Phase: 75% refund of amounts paid, as work has begun.
  • During Development Phase: Refund calculated proportionally based on work not yet completed. You will receive all completed deliverables.
  • Near Completion (90%+ done): No refund available, but all deliverables will be provided upon final payment.

3. Project Cancellation by Kudoby

In rare circumstances where Kudoby Technologies must cancel a project (e.g., unforeseen circumstances, conflict of interest), we will provide a full refund of any amounts paid for work not yet delivered. We will also provide all completed work and documentation up to the cancellation date.

4. Refund Eligibility

Refunds may be considered in the following situations:

  • Services not delivered as per the agreed Statement of Work.
  • Significant delays caused by Kudoby Technologies (exceeding 30 days from agreed milestones).
  • Critical bugs or issues that remain unresolved after reasonable attempts to fix.
  • Mutual agreement/termination of service capabilities.

5. Non-Refundable Items

The following are not eligible for refunds:

  • Third-party services, licenses, or subscriptions purchased on your behalf.
  • Work completed and approved by the client.
  • Rush or expedited service fees.
  • Consulting or discovery sessions already conducted.
  • Changes in client requirements after project approval.

6. Refund Process

To request a refund:

  1. Submit a written refund request to billing@kudoby.com.
  2. Include your project name, contract number, and reason for the request.
  3. Our team will review your request within 5 business days.
  4. If approved, refunds will be processed within 10-15 business days.
  5. Refunds will be issued using the original payment method.

7. Retainer Services

For monthly retainer clients:

  • Cancel with 30 days written notice to avoid the next month's charge.
  • No refunds for unused hours in the current billing period.
  • Unused hours may roll over as per your contract terms.
  • Annual retainer contracts may have different terms as specified in your agreement.

8. Dispute Resolution

If you disagree with a refund decision, we encourage open communication to resolve the issue. You may request a review by our management team. If we cannot reach a resolution, disputes will be handled according to the arbitration clause in your service agreement.
